FIELD, Justice. This is an action of tort. The declaration is in two counts, one for the death and the other for the conscious suffering of the plaintiffs intestate, who was run down by the defendants motor truck while crossing a street in Cambridge. The defendants motion for a directed verdict was denied and there was a verdict for the plaintiff on both counts. The case comes before us on the defendants exceptions to the denial of his motion for a directed verdict, to the refusal of the Judge to instruct the jury as requested, and to certain portions of the charge, and on the plaintiffs exceptions to the denial of his motion to dismiss the defendants bill of exceptions and to the refusal of the Judge to rule as requested.
