Appellant Richard Conoshenti alleges that his employment with Public Service Electric and Gas Company ("PSE&G") was terminated in violation of the Family and Medical Leave Act of 1993, 29 U.S.C. Â§ 2601 et seq., ("FMLA"), New Jersey public policy under Pierce v. Ortho Pharmaceutical Corp., 84 N.J. 58, 72, 417 A.2d 505, 512 (N.J. 1980), and the New Jersey Law Against Discrimination, N.J. Stat. Ann. Â§ 10:5-1 et seq., ("NJLAD"). The District Court granted summary judgment in favor of PSE&G on all of Conoshentis claims. We will reverse the District Courts judgment with respect to Conoshentis FMLA claim and remand for further proceedings. We will affirm, however, the District Courts judgment with respect to Conoshentis Pierce and NJLAD claims.
